Who we serve: Attorneys and their clients in all phases of litigation involving financial, economic and accounting issues, including financial reorganization, business valuation, forensic accounting, intellectual property, economic loss and construction-related cases.
Our approach:
Initial case assessment We help you assess the strengths and weaknesses of a claim by developing preliminary damage analyses, often (preferably) before a lawsuit is filed. This enables you and your clients to weigh the costs and potential benefits of litigation. Later, this analysis can help you evaluate settlement offers.
Investigative strategy We work closely with you and your client to identify liability and damage issues early, and then develop a relevant, thorough investigative and analytical strategy. To maximize our effectiveness and also help control the overall cost of litigation, we outline the investigation in phases, reassessing the status of the project after each phase is completed.
Discovery We work with our client to make sure that the relevant documents and depositions are gathered so that a complete and accurate analysis and expert report can be prepared. At the same time, to contain the cost of document production and review, we attempt to help you avoid the pursuit of information extraneous to the claim. Specifically, we can:
- Develop deposition questions for you to use with business, accounting and financial fact witnesses.
- Develop detailed deposition outlines, preparing you to depose opposing financial and economic experts.
- Attend the deposition of key witnesses to help you interpret technical financial issues and develop follow-up questions.
- Help you prepare interrogatories and discovery requests.
- Help you respond to discovery requests.
Expert witness reports Our reports are clearly, concisely written, thoroughly documented and supported with our underlying work papers and files. When appropriate, we include exhibits that illustrate our calculations, methodologies and analyses, and also meet the disclosure rules required for admissibility in trial. We can also help you evaluate and critique opposing expert witness reports and prepare for cross examination.
Testimony We have extensive experience as expert witnesses in bench and jury trials, and are well-versed in the Federal rules and case law (including Daubert and Kumho Tire) that impact expert witness testimony. Like our written witness reports, our testimony at trial is concise and thorough. We explain complex technical terms in simple language that can be easily grasped by non-financial experts. And we are well-prepared to anticipate and rebut the testimony of opposing witnesses and respond to cross-examination by opposing counsel.
