Case Studies - Utilities Class Action Case Study A Engagement The Defendant, a major retailer of energy and energy services, provides fixed price electricity and gas plans for residential customers and small businesses as an alternative to local utility companies. It was alleged in a class action lawsuit that the Defendant breached a contract it had with the Plaintiffs by charging fees in excess of those allowed under the agreement. Gleason's Role Gleason & Associates was retained to review extensive database software used by the Defendant to manage their customer records and forecasts. Gleason & Associates was responsible for isolating particular customer data, for updating and manipulating database code, and for identifying and correcting potential errors in the database. Results Gleason & Associates utilized its financial and consulting background to build Access and database-driven tools that were better able to assess a firm's position from a legal and economic value perspective. Gleason & Associates also assisted the client in assessing commonalities amongst potential members of the opposing class in the suit, and in assessing its potential liability exposure.
