Case Studies - Oil and Gas Intellectual Property Case Study A Engagement The plaintiff's expert asserted tens of millions of dollars in damage claims based on economic models for gas production and hypothetical joint venture arrangements. Gleason & Associates was hired by the defendant to analyze the damages asserted by the plaintiff and to prepare an alternative calculation of damages if there was a finding of liability for patent infringement. Gleason's Role Gleason & Associates was retained to analyze and provide a critique of the damage claim presented by the plaintiff's expert. Drawing on our expertise in the economic, financial, and operation aspects of gas extraction, we analyzed information produced by both sides in the litigation, reviewed and attended depositions, and conducted interviews with numerous client personnel to support our analysis. In addition, our experience with licensing agreements and licensing technology also allowed us to arrive at an alternative calculation that determined a reasonable amount of compensation to the patent holder if the patents were found to be valid, enforceable, and infringed. Results The valuable combination of our patent infringement litigation experiences with our deep knowledge of the extraction industry provided our client with a solid, credible expert opinion and analysis. The ultimate case settlement did not require our client to pay any damages for prior drilling activities.
