Case Studies - Oil and Gas Environmental Case Study A Engagement The Plaintiff was directed by governmental authorities to provide immediate assistance with the clean-up of an oil and chemical mix that had been released by another corporation in West Virginia. Subsequently, the Plaintiff was ordered by the West Virginia Department of Environmental Protection to assume primary control of the continuing abatement, clean-up and remediation activities for this incident. After an initial lawsuit was filed, the Plaintiff filed cross-claims against the Defendants to recover costs and related damages that were incurred by the Plaintiff related to the release. Gleason's Role Gleason & Associates was retained to calculate the present value of the projected future environmental remediation costs related to the Release as presented by an expert opinion. The opinion prepared three different cost scenarios. The present value was calculated as of the anticipated trial date. Results Under the scenarios presented by the expert opinion, Gleason & Associates calculated future environmental remediation costs ranging between $1mm and $5mm.
